ESFA Terms of Sale

Welcome to ESFA corp. s.r.o. (“ESFA”, “we”, “our”, “us”). These Terms of Sale (the “Agreement”) govern your purchase of any digital products, software integrations, platform subscriptions, virtual credits, or in-app services provided by ESFA and its affiliates (collectively “ESFA Content”).

This Agreement forms a binding contract between you (the “user”, “developer”, or “purchaser”) and ESFA corp. s.r.o., established under Slovak law.

By purchasing, accessing, or downloading ESFA Content, you agree to these Terms as well as to our User Agreement and Privacy Policy, which are incorporated by reference.

1. Eligibility and Access

You may purchase ESFA Content only if you are a resident of a country or region where ESFA operates and where such access is legally permitted.

ESFA reserves the right to deny or limit access to any purchase or service if fraudulent or unlawful activity is suspected.

ESFA Content may also be available through authorized third-party distributors. In such cases, your purchase is made with that third party and will be subject to their terms of sale. ESFA’s warranties described below still apply to ESFA-developed software and services.

2. Purchase and Payment Process

To complete a purchase, you may be required to register an ESFA Account.

When placing an order, you confirm that:

• you have reviewed all order details,

• you are authorized to use the chosen payment method,

• the billing information provided is accurate and current, and

• you accept the terms of this Agreement.

Submitting an order constitutes an offer to purchase ESFA Content at the stated price (“Purchase Price”). Once your order is sent, we will sent an invoice by email. Delivery of ESFA Content begins immediately upon confirmation.

You agree to maintain valid payment information. ESFA may use secure third-party payment processors or automatic card update services to ensure uninterrupted access to subscriptions or services.

Any attempt to use fraudulent payment information or unauthorized cards may result in suspension or termination of your account.

3. Pricing and Taxes

The Purchase Price for ESFA Content is displayed on the invoice and includes all applicable sales taxes, VAT, or digital service fees where required by law.

Exchange rates or processing fees applied by your payment provider are beyond ESFA’s control.

You are responsible for any additional costs related to your internet connection, data usage, or network access required to use ESFA Content.

4. Pre-orders and Early Access

From time to time, ESFA may offer pre-order access to upcoming tools, games, or integrations. Payment authorization may occur up to two weeks before release.

You may cancel any pre-order prior to the release date for a full refund. Upon release, early access content will automatically activate through your ESFA Account.

5. Transaction Records

You are responsible for monitoring your purchase and transaction history sent by ESFA into your email inbox.

If you notice unauthorized activity or discrepancies, contact ESFA Support immediately at [dev@esfagaming.com].

ESFA retains transaction records in accordance with applicable data and accounting regulations.

6. Transfers and Gifting

Only when explicitly supported within the ESFA ecosystem may you gift or transfer digital items, credits, or licenses to another user. Transfers are permitted only between accounts registered in the same country unless otherwise authorized by ESFA.

You are responsible for ensuring the recipient is correctly identified and eligible to receive the item.

7. Refunds and Cancellations

Except where required by applicable law, ESFA does not issue refunds for digital content once delivered.

Refunds may be granted at ESFA’s sole discretion in cases of technical failure, duplicate transactions, or other justified reasons.

For EU customers, your statutory right of withdrawal applies for 14 days after purchase, unless digital delivery begins with your express consent.

8. License and Use

Purchasing ESFA Content grants you a limited, non-exclusive, non-transferable license to access and use it for personal or authorized business purposes only.

You may not reverse engineer, modify, or resell ESFA Content unless explicitly permitted through a separate agreement.

9. Termination

ESFA may suspend or terminate your account or access to purchased content if fraudulent activity, abuse, or violation of this Agreement is detected.

You may close your account at any time by contacting ESFA Support.

10. Governing Law

This Agreement is governed by the laws of the Slovak Republic, excluding conflict of law principles.

Any disputes arising from or related to this Agreement shall be resolved in Slovak courts unless mandatory consumer protection laws dictate otherwise.

12. Final Provisions

ESFA reserves the right to modify these Terms of Sale at any time. The updated version will be posted on our website with a revised “Last Updated” date. Continued purchases or use of ESFA Content after such changes signify your acceptance of the new terms.

If any provision of this Agreement is found unenforceable, the remaining terms remain in effect.
